Even before the Biden's atrocious debate performance, Joe Biden has shown frequent failures of mental acuity critical for any President. These lapses have only increased in frequency pointing to an accelerating neurodegerative disease. This is a serious concern for the American people and the world. Here are examples and articles of concern:

The Democratic Party and White House Have Denied This for Years

Democratic leadership and major news outlets have denied for years. They have dismissed concerns about Biden's mental health as conspiracy theories. However, the evidence prior to the debate was overwhelming and the American people deserved a frank discussion. The denials absurdly continue even after Biden's debate performance. Here are some examples:

Calls for Biden to Step Down are Accelerating

The writing is on the wall for Joe Biden. Prominent figures and law makers are increasingly vocal about their concerns, urging a swift and decisive response to ensure the future of the Democratic Party. Here are some examples:

Biden does not seem willing to do what's best for the American people.Both he and his wife have been defiant in the face of calls for him to step down gracefully. As such, we may be forced to take more drastic measures to ensure the future of the Democratic Party by invoking the 25th amendment. Here are some examples of Biden's aggressive pushback:

25th Amendedment

A Necessary Last Resort

The 25th Amendment to the United States Constitution deals with presidential succession and disability. It was ratified in 1967, following the assassination of President John F. Kennedy, to clarify the procedures for replacing a president or vice president who is unable to fulfill their duties.

Key Provisions of the 25th Amendment

Section 1: Presidential Succession

Establishes that if the President is removed from office, dies, or resigns, the Vice President becomes President.

Section 2: Vice Presidential Vacancy

If the Vice Presidency is vacant, the President nominates a new Vice President who takes office after confirmation by a majority vote of both Houses of Congress.

Section 3: Voluntary Presidential Disability

Allows the President to voluntarily declare their inability to discharge the powers and duties of the office by transmitting a written declaration to the President pro tempore of the Senate and the Speaker of the House of Representatives. The Vice President then becomes Acting President until the President declares in writing that they are able to resume their duties.

Section 4: Involuntary Presidential Disability

Provides a process for the Vice President and a majority of the principal officers of the executive departments (or another body designated by Congress) to declare the President unable to discharge the powers and duties of the office. They must transmit a written declaration to the President pro tempore of the Senate and the Speaker of the House of Representatives. The Vice President immediately assumes the role of Acting President.

  • If the President disputes this declaration, they can send a written declaration to the President pro tempore of the Senate and the Speaker of the House of Representatives stating that no inability exists. The President resumes the powers and duties of the office unless the Vice President and a majority of the principal officers of the executive departments (or another body designated by Congress) send another declaration within four days asserting that the President is unable to discharge the powers and duties of the office.
  • If the second declaration is made, Congress must decide the issue. Congress must assemble within 48 hours if not in session and must decide within 21 days (or 21 days after Congress is required to assemble) whether the President is unable to discharge the powers and duties of the office. A two-thirds vote in both Houses is required to keep the Vice President as Acting President. If Congress does not reach the two-thirds majority, the President resumes their duties.

Application to Replace a President

If there are concerns about President Joe Biden's mental health and he is unwilling to step down voluntarily, Section 4 of the 25th Amendment could be invoked:

  1. Initiation: The Vice President (currently Kamala Harris) and a majority of the principal officers of the executive departments would need to submit a written declaration to the President pro tempore of the Senate and the Speaker of the House of Representatives stating that President Biden is unable to discharge the powers and duties of his office.
  2. Acting Presidency: Vice President Harris would immediately assume the role of Acting President.
  3. Dispute: If President Biden disputes the declaration, he can submit a written declaration stating that he is capable of performing his duties. He would then resume his role unless the Vice President and the majority of the principal officers submit another declaration within four days asserting his inability.
  4. Congressional Decision: If the dispute persists, Congress must convene within 48 hours to decide the matter. Within 21 days, Congress must determine by a two-thirds vote in both Houses whether President Biden is unable to discharge the powers and duties of his office. If the two-thirds majority is achieved, Vice President Harris continues as Acting President. If not, President Biden resumes his duties.
